Last updated: November 3, 2026
For riders in New York who were sexually assaulted by an Uber driver, with New York's filing deadline for survivors. Lyft riders can ask too.
Riders allege that Uber did not do enough to protect passengers from its drivers. Federal cases are coordinated in MDL 3084 in the Northern District of California; a New York rider's case can be filed in the New York Supreme Courts or in federal court. These are allegations being litigated, decided case by case. NuLegal reviews these claims at no cost and connects qualified claimants with trial counsel.
New York Filing Deadline for Survivors
New York has deadline rules of its own for adult survivors of sexual assault, set out on this page. Its usual injury deadline is 3 years.
Deadlines as stated on November 4, 2026, read from the statute.
Can reach a claim against a company
20 years
Clock starts: The date of the conduct (the statute says only "within twenty years").
When it applies: Conduct that would be first-degree rape, certain second- or third-degree rape, aggravated sexual abuse in the first degree, or incest in the first or second degree under the Penal Law; no criminal charge or conviction needed.
Which incidents it covers: Acts on or after 2019-09-18, and earlier acts whose previous period had not expired by then.
Who it reaches: The words of this rule can reach a claim against a company, not only against the person who did it. A review checks whether that includes Uber on your facts.
N.Y. C.P.L.R. 213-c (L.2019, ch. 315, § 4)
Against the person who did it only
At least 5 years
Clock starts: The end of the criminal case.
When it applies: A criminal action for first-degree rape (or aggravated sexual abuse in the first degree) was commenced against the same defendant.
Who it reaches: This reaches only a claim against the person who did it. For a claim against a company such as Uber, look to the other rules on this page; where none of them applies, the usual injury deadline, 3 years, governs.
N.Y. C.P.L.R. 215(8)(b)
A deadline turns on the facts: when the ride was, and whether the claim is against Uber or against the driver. Some states also set a shorter deadline for an assault claim against the person who did it. Do not assume a deadline has passed. A review checks which rule applies before anything is filed.
Where a New York Case Is Filed
A New York claim can be brought in the New York Supreme Courts, or in federal court, where the districts covering New York are the Northern District of New York, Southern District of New York, Eastern District of New York, and Western District of New York.
A federal case is transferred into MDL 3084 before Judge Charles R. Breyer in the Northern District of California for coordinated pretrial work. That transfer groups cases that share common questions. It decides nothing about whether any of them has merit, and it does not mean a New York rider has to travel to California.
If it was a Lyft ride, the same kind of claim is coordinated separately, in MDL 3171. You can still ask for a review here.
