Uber Sexual Assault Lawsuit in Illinois

Last updated: November 3, 2026

For riders in Illinois who were sexually assaulted by an Uber driver, with Illinois's filing deadline for survivors. Lyft riders can ask too.

Riders allege that Uber did not do enough to protect passengers from its drivers. Federal cases are coordinated in MDL 3084 in the Northern District of California; an Illinois rider's case can be filed in the Illinois Circuit Courts or in federal court. These are allegations being litigated, decided case by case. NuLegal reviews these claims at no cost and connects qualified claimants with trial counsel.

Illinois Filing Deadline for Survivors

Illinois has deadline rules of its own for adult survivors of sexual assault, set out on this page. Its usual injury deadline is 2 years.

Deadlines as stated on November 4, 2026, read from the statute.

Can reach a claim against a company

4 years

Clock starts: When the claim accrued (for a survivor who was a minor, age 18).

When it applies: A Gender Violence Act claim against the assailant's employer: violence in the workplace by an employee or agent acting in the course of the job, where the employer failed to supervise, train or monitor, or failed to act on earlier complaints.

Who it reaches: The words of this rule can reach a claim against a company, not only against the person who did it. A review checks whether that includes Uber on your facts.

740 ILCS 82/20; 82/11

Unsettled whether it reaches a company

2 years

Clock starts: When the claim accrued, not counting any time the survivor is under threats, intimidation, manipulation or fraud by the perpetrator or someone acting in the perpetrator's interest.

When it applies: Injury caused by sexual conduct or sexual penetration as defined in 720 ILCS 5/11-0.1.

Which incidents it covers: Claims arising on or after January 1, 2008, or not yet expired on that date.

Who it reaches: The statute's words do not settle whether this reaches a claim against a company such as Uber. A review confirms it.

735 ILCS 5/13-202.3

Against the person who did it only

7 years

Clock starts: When the claim accrued (for a survivor who was a minor, age 18).

When it applies: A claim under the Gender Violence Act: a physical intrusion or invasion of a sexual nature under coercive conditions that meets the elements of battery; no criminal charge or conviction is needed.

Who it reaches: This reaches only a claim against the person who did it. For a claim against a company such as Uber, look to the other rules on this page; where none of them applies, the usual injury deadline, 2 years, governs.

740 ILCS 82/20; 82/5; 82/10

A deadline turns on the facts: when the ride was, and whether the claim is against Uber or against the driver. Some states also set a shorter deadline for an assault claim against the person who did it. Do not assume a deadline has passed. A review checks which rule applies before anything is filed.

Where an Illinois Case Is Filed

An Illinois claim can be brought in the Illinois Circuit Courts, or in federal court, where the districts covering Illinois are the Northern District of Illinois, Central District of Illinois, and Southern District of Illinois.

A federal case is transferred into MDL 3084 before Judge Charles R. Breyer in the Northern District of California for coordinated pretrial work. That transfer groups cases that share common questions. It decides nothing about whether any of them has merit, and it does not mean an Illinois rider has to travel to California.

If it was a Lyft ride, the same kind of claim is coordinated separately, in MDL 3171. You can still ask for a review here.
